OCI/NRI Documentation Checklist for Buying Nikoo Homes 9
Buying property in India from abroad involves a specific set of documents — FEMA-compliant proofs, Indian PAN, overseas attestations, and (usually) a Power of Attorney. Get the paperwork right the first time and the entire Nikoo Homes 9 purchase from EOI to registration can be completed in 45–60 days without you flying to India. Get it wrong and you'll be stuck in RBI/FEMA delays for months. This checklist walks you through everything you need, in order, whether you are an NRI in the UAE, US, UK, Singapore, or anywhere else.
Step 1 — Confirm your eligibility status
Before collecting documents, clarify your legal status under Indian law:
- NRI (Non-Resident Indian): An Indian citizen who has stayed outside India for more than 182 days in the preceding financial year, or moved abroad for employment / business / indefinite stay.
- OCI (Overseas Citizen of India): Someone of Indian origin who holds foreign citizenship and has been granted an OCI card (essentially a lifetime India visa).
- PIO (Person of Indian Origin): The old category, now merged into OCI since 2015. If you still have a PIO card, apply for OCI conversion.
All three categories can buy residential property in India freely under FEMA, without any special RBI approval. Purchase of agricultural land, plantation property, and farmhouses is NOT permitted. Nikoo Homes 9 being a residential apartment township is fully within the permitted category for all NRI / OCI buyers.
Step 2 — Core personal documents (must have)
This is the base documentation required for any NRI/OCI property purchase in India:
- Valid Passport — with at least 6 months validity remaining. First and last pages photocopied.
- Overseas Visa — work visa, resident permit, or OCI card page from passport
- OCI Card (if applicable) — original + photocopy
- Overseas Address Proof — utility bill (electricity/gas/water) not older than 3 months, tenancy agreement, driving license, or bank statement
- Indian PAN Card — MANDATORY for property purchase in India. Apply for one if you don't have it (takes 15-20 days via e-Filing portal or NSDL)
- Passport-size photographs — 6 to 8 recent colour photographs on white background
- Overseas ID proof — Emirates ID / Social Security Card / NHS number, etc. depending on country
Step 3 — Financial documents (for home loan / income proof)
Whether you are self-financing or taking an NRI home loan, banks and the developer will typically ask for:
- Employment contract / Appointment letter from your overseas employer
- Recent salary slips — last 3 to 6 months
- Overseas bank statements — last 6 to 12 months (personal salary account)
- Overseas Income Tax Returns (ITR) — last 2 years (or country-equivalent tax filing)
- Indian ITR — last 2 years, if you file in India (rental income, capital gains, etc.)
- Form 16 / TDS certificates from Indian income (if applicable)
- Existing loan statements — if you have any active loans in India or abroad
- Credit report — from your overseas credit bureau (Experian, Equifax, Etihad Credit Bureau, etc.)
- Business proof — if self-employed: trade license, LLC registration, articles of incorporation
Step 4 — Banking setup (for payment)
NRI property payments cannot be made from a regular resident savings account. You need at least one of the following NRI-designated bank accounts:
- NRE (Non-Resident External) Account — for foreign-earned income; principal and interest fully repatriable
- NRO (Non-Resident Ordinary) Account — for India-earned income (rent, dividends); limited annual repatriation
- FCNR (Foreign Currency Non-Resident) Deposit — foreign currency deposits with fixed tenure
Any Indian bank offers these. If you don't have one, apply before starting the property process (takes 7-15 days). You'll also need the account statements as source-of-funds proof.
Step 5 — Power of Attorney (POA) — usually essential
Unless you plan to fly to India for every signing event, a POA is essential. It authorises a trusted person in India (family member, sibling, close friend, or a paid agent) to act on your behalf for: signing the sale agreement, sale deed registration, taking possession, and even sometimes managing the loan process.
Where to execute the POA:
- Go to the Indian Embassy / Consulate in your country of residence
- Draft the POA (specific to property purchase at Nikoo Homes 9) — get a lawyer to prepare or use standard templates from your Indian bank
- Sign the POA in front of the Consulate officer
- Get the POA attested / notarised by the Indian Consulate
- Courier the attested POA to your POA holder in India
- The POA holder must register the POA at the Sub-Registrar office in India within 3 months of your arrival in India, OR pay the applicable stamp duty (varies by state; ₹500-1,000 typically) to make it valid
Some countries (Hague Convention members) allow Apostille instead of Consulate attestation — check with your local Indian mission. Apostille is faster and cheaper.
Step 6 — Country-specific requirements
USA-based NRIs / OCIs
- W-2 form or 1099 forms (last 2 years)
- Federal tax returns (last 2 years)
- SSN not always required but useful; ITIN accepted
- Bank statements from a US bank (JPMC, BOA, Wells Fargo, etc.)
- POA attestation via Indian Consulate in NYC/San Francisco/Chicago/Houston/Atlanta
UAE / Gulf-based NRIs
- Emirates ID (UAE) / Qatar ID / Iqama (Saudi Arabia)
- Employment offer letter attested by Ministry of Labour
- Salary certificate from employer
- Bank statements from UAE bank (Emirates NBD, ADCB, FAB, etc.)
- POA attestation via Indian Consulate in Dubai / Embassy in Abu Dhabi
- MoFA attestation may also be required for some documents
UK-based NRIs / OCIs
- P60 form (annual tax certificate)
- Self Assessment tax returns (if self-employed)
- Bank statements from UK bank (HSBC, Barclays, Lloyds, etc.)
- UK Council Tax bill as address proof
- POA attestation via Indian High Commission in London
- Apostille via UK Foreign, Commonwealth & Development Office (FCDO)
Singapore-based NRIs / OCIs
- Notice of Assessment (NOA) from IRAS
- CPF statements (if applicable)
- Employment Pass / S-Pass copy
- POA attestation via Indian High Commission in Singapore
Australia / Canada / EU-based NRIs
- Tax return / T1 / equivalent country tax filing
- Employment letter and pay slips
- Bank statements from local bank
- Apostille (all these countries are Hague Convention members)
Step 7 — Property-specific documents (to be signed)
At the actual purchase stage, you'll be signing / receiving:
- Application form / EOI form — signed by you or POA holder
- Booking receipt — for the booking amount paid
- Allotment letter — from Bhartiya Urban confirming your unit
- Agreement to Sell / Sale Agreement — registered at Sub-Registrar
- Payment Schedule — Construction-Linked Plan or Time-Linked Plan
- Sale Deed — executed at handover, registered
- Possession Letter — issued by developer at handover
- Occupancy Certificate — from BBMP (Bruhat Bengaluru Mahanagara Palike)
- Khata Certificate — post-registration property tax record
- TDS Certificate — 1% TDS deducted by buyer if unit > ₹50 lakh (mandatory for NRIs too)
Step 8 — Tax and repatriation setup
Talk to an NRI-focused Chartered Accountant BEFORE booking. They will help with:
- DTAA (Double Taxation Avoidance Agreement) between your country and India — critical for rental income and capital gains
- Form 15CA / 15CB — required for large repatriation of funds abroad
- Tax withholding structure for rental income (typically 30% + surcharge for NRIs)
- Long-term capital gains structuring — 20% with indexation after 2 years
- Section 195 — TDS on NRI property purchase (1% on sale amount for buyer)
- Repatriation limits — up to USD 1 million per financial year from NRO account
Step 9 — Timeline overview
Assuming you start today with all documents in hand:
- Week 1: Register EOI for Nikoo Homes 9 (free)
- Week 2: Complete NRI bank account setup (NRE/NRO/FCNR)
- Week 2-3: Get overseas documents attested by Indian Consulate
- Week 3-4: Apply for NRI home loan pre-approval (parallel)
- Week 4: Execute POA at Indian Consulate
- Week 5: Courier POA to India, POA holder registers at Sub-Registrar
