NRI Home Loan Guide for Buying Property in India

For NRIs looking at Indian real estate — whether for eventual return, family use, or long-term investment — a home loan often makes the maths work better than an all-cash purchase. Foreign currency earnings, tax benefits under Section 24, and rupee-hedged repayment through NRE/NRO accounts create a genuinely compelling picture. Here's what to know before you apply.

1. Who qualifies as an NRI for home loan purposes?

Under FEMA (Foreign Exchange Management Act), you're considered an NRI (Non-Resident Indian) if you've been outside India for more than 182 days in the preceding financial year, OR if you've moved abroad for employment / business / any other purpose indicating an indefinite stay. Persons of Indian Origin (PIO) and Overseas Citizens of India (OCI) card holders also qualify for NRI home loans on similar terms.

2. What loan-to-value (LTV) can NRIs get?

Major Indian banks offer NRI home loans typically up to 80% of the property value. Some lenders like SBI, HDFC, and ICICI go up to 85% for smaller ticket sizes. Loan amounts are usually capped based on repayment capacity (NRI's monthly income after existing obligations), with a debt-service ratio of around 60-65% of net income.

3. Interest rates and tenure.

NRI home loan interest rates in India are almost identical to resident rates — currently in the 8.5-9.5% range. Tenures go up to 20-30 years, though NRI loans often have a slightly shorter maximum tenure (typically 25 years or up to age 60-65 at loan maturity). You can choose fixed, floating, or hybrid rate structures.

4. Documentation checklist.

The core NRI home loan documentation includes:

  • Passport with valid visa / OCI card
  • Overseas address proof (utility bill, driving license, tenancy agreement)
  • Indian PAN card (mandatory)
  • Employment contract / offer letter
  • Salary slips (last 3-6 months)
  • Overseas bank statements (last 6 months)
  • Overseas ITR (last 2 years) or equivalent tax filing
  • Indian ITR (last 2 years, if filed in India)
  • Property documents (agreement to sell, sale deed, approval plans)
  • Passport-size photographs
  • Power of Attorney (if using a POA holder in India)

All documents from overseas typically need attestation from the Indian Embassy/Consulate or apostille (for Hague Convention countries).

5. Repayment: NRE, NRO, or FCNR?

NRI home loan EMIs must be paid from one of the following:

  • NRE (Non-Resident External) account — for foreign-earned income; fully repatriable
  • NRO (Non-Resident Ordinary) account — for India-earned income (like rent); limited repatriation
  • FCNR (Foreign Currency Non-Resident) account — foreign currency deposits
  • Direct inward remittance from abroad

You cannot use a resident savings account or unclaimed rupee funds.

6. Tax benefits.

NRIs get the same home loan tax benefits as resident Indians:

  • Section 24(b): Interest deduction up to ₹2 lakh per year (self-occupied)
  • Section 80C: Principal repayment deduction up to ₹1.5 lakh per year
  • Section 80EEA: Additional ₹1.5 lakh interest deduction for first-time buyers (conditions apply)

These deductions apply against India-taxable income. NRIs whose only Indian income is rental/capital gains may benefit less than those with substantial Indian income.

7. Bank options for NRI loans.

The most active NRI-lending banks in India are:

  • SBI NRI Home Loan — largest reach, competitive rates
  • HDFC (now HDFC Bank) — strongest NRI product depth, best digital experience
  • ICICI Bank NRI Home Loan — good for GCC-based NRIs
  • Axis Bank — flexible eligibility, useful for self-employed NRIs
  • LIC Housing Finance NRI — attractive for larger tickets
  • Bajaj Finserv — quick approvals, higher rates
  • PNB Housing Finance — competitive for salaried NRIs

8. Power of Attorney (POA) — usually essential.

Most NRIs cannot fly to India for every loan-signing, property registration, or documentation event. A Power of Attorney executed at the Indian Embassy/Consulate in your country of residence (and stamped in India within 3 months of arrival) authorises a trusted person to act on your behalf. This one document eliminates 80% of the physical-presence friction.

9. Common mistakes to avoid.

  • Applying without pre-approval — pre-approval speeds everything up
  • Underestimating documentation timelines (allow 30-45 days)
  • Choosing loan tenure that runs past retirement age — banks will restrict
  • Not accounting for currency risk if EMI is INR but earnings are USD/AED/GBP
  • Ignoring insurance — always take property insurance and loan-linked term cover
  • Skipping RERA verification of the underlying project

10. How to get started.

The best sequence is: (1) register EOI on the project you're interested in, (2) get pre-approval from 2-3 banks in parallel, (3) shortlist unit and negotiate, (4) execute POA at your local Indian consulate, (5) proceed to booking and loan sanction. Total time from EOI to sanction: typically 45-60 days for NRIs with clean documentation.
